Intention to take deposition filed in suit over vacuum hose falling on worker

A notice of intention to take deposition by written questions has been filed in a personal injury lawsuit. contract-signing

As previously reported, Liberty County resident Byron Eckhart filed suit against Miller Environmental Services on June 14, 2012, in Jefferson County District Court, alleging a vacuum hose fell on him while on a job.

Court records show that the notice was filed June 4, seeking the deposition of the custodian of records for Republic Services Inc.

Defendant Miller’s attorney, Steven Belsky of the Houston law firm Browns Sims, filed the notice.

The lawsuit alleges that on Sept. 25, 2011, Eckhart was working at a Total Petrochemical refinery when a large industrial vacuum hose fell on him.

The suit accuses Miller Environmental Services of negligence but does not list a specific act of negligence allegedly committed by the defendant.

Eckhart is suing for his alleged past and future medical expenses, mental anguish, pain, impairment and lost wages, plus all court costs.

Baytown attorney Scott Lannie represents him.

Judge Donald Floyd, 172nd District Court, is assigned to the case.
